Debt Collection A to Z: I is for Illegal


Creditors and debt collectors sometimes go over the line in the quest for money and property.  A few of these illegal actions are wrongful repossession, remote/GPS shutdown of a vehicle when the consumer is not in default, using a consumer’s information to run credit or seek financing  illegalwithout the consumer’s authorization, threats of violence or intimidation, excessive and/or abusive phone calls, and broadcasting a consumer’s debt to third parties. These actions can cause consumers to lose sleep, money, friends, employment, contracts, dignity, and other things.

Fortunately there are rules and laws to protect persons who are subjected to illegal actions.  At the federal level these laws include the FCRA, FDCPA, FACTA, SSCRA, TILA and several more.  In North Carolina we have the CFA, IDTPA, and RISA.  Instead of trying to sort out these laws and figure which ones may protect you it is best to seek experienced legal counsel to discuss your situation.
